It is intended that the student will be given an overview of many of the major topics which require coverage at this introductory level. Students are strongly advised to work through each of the individual areas consecutively in order to allow their knowledge base to grow as necessary. Any attempt to move out of sequence is to be discouraged because this may cause unnecessary confusion.
Health and Safety in the workplace is becoming an ever growing concern for employees and employers. The course will appeal to a wide variety of people, those looking for a change of career or those looking to gain a greater knowledge in this particular segment of the Law.
Materials can be studied online or students have the option to print the documents once, there is also the option to have the materials delivered for an additional charge.
No previous knowledge or experience is essential to study this course.
This Level 3 Diploma in Health and Safety Law is Quality Assured by OLQA. The Diploma is awarded by Oxford College. Upon completion of the course you will receive certification awarded by Oxford College. The qualification does not carry UCAS points but is recognised by employers and some universities as a level 3 qualification. For entry into university students will need to check the relevant university’s entry requirements to see if they will accept a Level 3 Diploma in place of A Levels / UCAS points.
At the end of this course successful learners will receive a Certificate of Achievement from Quality Licence Scheme and a Learner Unit Summary (which lists the components the learner has completed as part of the course).
The course has been endorsed under the Quality Licence Scheme.The Provider has undergone an external quality check to ensure that the organisation and the courses it offers, meet defined quality criteria. The completion of this course alone does not lead to a regulated qualification* but may be used as evidence of knowledge and skills gained.
The Learner Unit Summary may be used as evidence towards Recognition of Prior Learning if you wish to progress your studies in this subject. To this end the learning outcomes of the course have been benchmarked at QLS Level 3 against level descriptors published by Ofqual, to indicate the depth of study and level of demand/complexity involved in successful completion by the learner.

Module 1: The legal sources
Health and Safety law is derived from a number of very different sources. Some of them are comparatively old, for example Common Law liability, whereas others are very much more recent, for example the multitude of European directives with which we are continually subjected. The purpose of this module is to try to place the subject in its rightful perspective by providing an overview of the major sources.
Module 2: The legal machinery
In module 1 we examined the sources. In this module we consider how they are put into action hence the need to consider the institutions and procedures in question. Therefore we look at the various courts, tribunals, forms of ADR and the types of action which may be appropriate to a particular case; for example criminal and civil procedures. We also consider the merits or otherwise of the system as it presently stands.
Module 3: Civil liability
This is the first treatment of a substantive area of Health and Safety law and we will be considering the liability that an employer may incur should he fail in his duty of care under common law. Despite the age of this remedy, it remains a vital safeguard for the employee in the event of an industrial injury.
Module 4: Vicarious liability
In this module we consider situations under which the employer will be liable for wrongful and, often, potentially dangerous acts committed by his employees. Having done this, we consider the primary statutory provisions which relate to this area.
Module 5: Discrimination
During the course of this module, we address the often distressing and harmful practice of discrimination in the workplace. We consider a whole range of areas which have been subject to legislative action both by our domestic Parliament and European sources of law
Module 6: The role of common law and equity
The essence of this module is a review of the common law mechanisms coupled with an insight into the relevance of equity. Having completed this we then review some of the important cases within the syllabus area.
Module 7: Criminal law and the consumer
This module provides an overview of consumer law provisions and how it is necessary to input criminalise certain activities within this area with a view to protecting the health and safety of the consumer. We consider a range of criminal offences coupled with their enforcement mechanisms.
Module 8: European law and the consumer
In a similar vein to the above we look at the influence of European Law with regards to our safety as consumers. Students are required to draw their knowledge of both legal sources and mechanisms gained in earlier modules.
Module 9: Implications for human resource practitioner
During the course of this module we consider the implications for the human resource practitioner and how they can best seek to ensure that the major legal requirements are adhered to whilst still trying to ensure that the needs of staff remain a paramount consideration at all times.
Module 10: Implications for management
In this final module, we look at the major legal implications for management and some of the essential processes of which they need a basic awareness; for example, the dismissal process and accident investigation.

The course operates through a study pack and access to your own personal tutor. Once you have chosen your course we will send you your study pack, which you will be required to work through before completing the course.
Depending on the course you have chosen, you will either be required to complete assignments and submit these for marking as the course progresses and/or be required to sit an end exam. The end exam could be in the form of multiple choice questions, or be an invigilated exam at a registered test centre.
Your completed assignments will need to be sent to your tutor for marking/assessment, you will then receive written feedback and guidance. It may be possible to submit your assignments by email, however you will need to check this with your tutor. Certain types of qualifications, A-levels and GCSEs for example, do require you to sit an invigilated exams at a registered test centre. Yes, there are no geographical limits to where you can study.
You just need to be aware that all tutors are based in the UK and work may need to be submitted to them via post, although in most cases e-mail can be used.
Where the course requires that you sit an invigilated exam at a test centre, there are many exam centres outside of the UK. However, we would advise that you check with us before purchasing one of these courses if you want to study from abroad.

A reasonable adjustment is any action that helps to reduce the effect of a disability or difficulty that places the candidate at a substantial disadvantage in the assessment situation. Reasonable adjustments must not affect the integrity of what needs to be assessed, but may involve:
Changing standard assessment arrangements, for example allowing candidates extra time to complete the assessment activity Adapting assessment materials, such as providing materials in Braille Providing access facilitators during assessment, such as a sign language interpreter or a reader Re-organising the assessment room, such as removing visual stimuli for an autistic candidate.
Reasonable adjustments are approved or set in place before the assessment activity takes place; they constitute an arrangement to give the candidate access to the assessment activity. The use of a reasonable adjustment will not be taken into consideration during the assessment of a candidate’s work.
Awarding organisations and centres are only required by law to do what is ‘reasonable’ in terms of giving access. What is reasonable will depend on the individual circumstances, cost implications and the practicality and effectiveness of the adjustment. Other factors, such as the need to maintain competence standards and health and safety, will also be taken into consideration.
