By placing an order online or by any other means (telephony or proforma) with us you will be deemed to have read, understood and agreed to these Terms and Conditions.

1. Definitions

In this terms and conditions document unless otherwise stated:

  1. "NCC" means NCC Home Learning/NCC Resources LTD
  2. "Distance Learning Package" shall mean the course(s) identified, all related Materials and support, where applicable; "Materials" means the learning materials and books for the NCC course or any part of them;
  3. "Services" means the support and tuition relating to the chosen NCC course, as described on the website;
  4. "Support Period" means one year from the date of the Sale Agreement or otherwise as stated in your course materials;
  5. "Price" means the price of the Materials, Tutor Support Services, Student Registration and Certification Fees, but does not include postage and packing;

Singular words shall include the plural and vice versa; and headings are included for convenience only and shall not affect the construction or interpretation of these terms and conditions

2. Payments

  1. We agree to sell and you agree to buy the Distance Learning Package for the Total Cost/Cash Price and on the terms set out in this document.
  2. The Price is payable prior to the delivery of the Materials by your chosen method (in full or by instalments), either by credit/debit card or cheque.
  3. Prices do not include any external exam fees, which may apply to certain courses such as A Levels and GCSEs.
  4. The price payable includes all materials, full support, Awarding Body registration and certification fees but does not include external exam fees which may apply to certain courses, such as A Levels and GCSE. In the event that the purchaser does not engage with the learning process via their tutor within 2 months from supply or fails to complete their payment plan, then the supply would revert to the provision of learning material only.
  5. Under no circumstances shall we be deemed to have received payment until payment has actually been received by us in full.
  6. We reserve the right from time to time to change the amount of the cost of the course. The current price for any given course will be displayed on the website.
  7. Learners who pay for their course by instalments and complete before full payment is received will not be issued with final certification until full payment is made.
  8. In the event that your monthly payment fails, the card used for your deposit will be charged if we are unable to reinstate your direct debit or if you cancel without NCC's prior approval.
  9. Learners who choose to pay for their course by Direct Debit will be required to adhere to the terms set out regarding monthly payments.
  10. Customers who choose to cancel Direct Debit payments will automatically have their course suspended and will be required to make alternative arrangements to cover the full outstanding cost as soon as possible. NCC will attempt to take payment from your original payment method (credit/debit card) if no contact is made within 48 hours to re-instate your direct debit payments.
  11. Learners will not be provided with additional time to complete their course to cover any suspended period due to instalment issues.
  12. NCC will add any missed Direct Debit payment that is returned by the bank to the Direct Debit payment due the following month. This will result in a double payment and the customer is required to make sure that sufficient funds are available to cover this. Where possible, NCC will attempt to make payment from your original payment method (credit/debit card).
  13. Learners will incur additional charges for failed payments, charged at £12 per failed payment and £12 for any subsequent correspondence via email, letter or phone call.
  14. If your account remains in arrears for more than 30 consecutive days we reserve the right to pass your details on to an external collection agency who will be instructed to collect the due balance on our behalf. An additional 20% + VAT will be added to the balance outstanding to cover administration and collections fees.
  15. You may be liable to charges under the Late Payment of Commercial Debts (Interest) Act 1998 as follows: for a debt less than £1000.00, the sum of £40.00 & VAT; for a debt of £1000.00 or more, the sum of £70.00 & VAT in addition to statutory interest of 8% above base calculated daily.
  16. Should you raise an indemnity claim against any direct debit payment, we reserve the right to add a further £30 per claim to the balance outstanding to cover administration and collections fees.
  17. For payment plans, the customer has the right to settle any outstanding amount in advance of their direct debit collection date(s). By settling any outstanding amounts ahead of schedule, the customer agrees to pay the remaining balance in full. To start the process please contact [email protected].
  18. To receive a price match, the student must follow the guidelines stated on the pricematch guarantee page. NCC will match that price for up to 7 days following the student’s purchase and give an additional 5% off the course price if paid in full. Price matches are limited to PI coded courses unless any special arrangements are agreed.
  19. Learners who choose to pay via a monthly payment plan acknowledge that they are aged 18 or over, or have consent from a legal parent or guardian.

3. Delivery and care of the materials

  1. We will release all the Materials to you in one dispatch usually within 2-5 working days of receiving payment from you.
  2. Materials will be sent by post or courier to the address you have given us.
  3. You will inspect the Materials upon delivery and will inform us immediately if there are any damages or omissions.
  4. You will be deemed to have accepted the Materials if you do not notify us within seven days after delivery.
  5. Risk of damage or loss in the Materials will pass to you upon delivery.

4. Services

  1. Each course is allocated with an initial twelve month support period unless detailed differently on an individual course page. During the Support Period, you will be provided with support and tuition as set out on the website or materials.
  2. If requested, we may at our sole discretion, extend the Support Period which may incur an agreed fee.
  3. A copy of student coursework is required for audit purposes and unless we receive a written request to the contrary, course work submitted to NCC for marking will not be returned and is sent entirely at the responsibility of the student. Students are advised to keep copies of all work submitted to NCC.
  4. If you are sitting an external examination at the end of your course, we will provide you with such information as we have in our possession to assist you in making such examination arrangements. In all other respects, you will be solely responsible for making arrangements to enable you to sit the examination and for any and all fees in relation thereto.
  5. If we, at our sole discretion, assist you in making your examination arrangements by providing you with information about the time and location of local examinations or reserving an examination place for you, you acknowledge that we shall not be responsible for any losses incurred by you as a result of inaccurate information provided in connection with any such arrangement.
  6. NCC works with a number of Awarding Organisations (AOs) and reserves the right to arrange learner certification through alternative AOs other than those advertised should the need arise due to operational requirements.
  7. Awarding Organisations (AOs) may update their course specifications at any time. Whilst NCC will endeavour to give adequate notice to learners should any actions be required on their part, NCC are not obliged to offer any compensation or refunds to learners if such an event occurs. NCC will endevour to offer an alternative course, version of the course or an alternative course of equal merit and content. 
  8. Your tutor will normally mark your assignment within 12 working days, although around holiday times it may take a little longer. If you submit more than one assignment at once, your tutor is not expected to mark and provide feedback for every assignment submitted, within the initial 12 working days. If you have not received feedback for an assignment after two weeks, please contact the student helpline.
  9. Your tutor will need to retain your assignments for moderation purposes (checking by another person). Tutor support is inclusive of answering queries and marking work, completion within your tutor support period is mandatory - work submitted after your support period has ended will not be marked unless an extension is granted.
  10. Students who have exceeded their 12 month support period will be liable to pay an extension fee in order to continue studying towards completion. Extension fees are charged at either £60 per month for the remainder of the course, or £195 to extend by a year. Extensions are granted at our discretion (we cannot grant extensions on qualifications nearing expiry for example).
  11. If you have allowed your support period to lapse, but you then wish to continue to submit work, you may be required to reactivate your course. This reactivation will be granted at our sole discretion, and may incur a one-off reactivation fee, normally charged at £10 per month, for each month outside of the support period (up to a maximum of £120). This charge is in addition to any fee incurred by extending your support period.
  12. Tutor feedback will be provided electronically to your email address, if you require a paper copy of your feedback there will be an administration and postage charge of £10 each time a copy is sent.
  13. Learner work and tutor feedback received will be scanned into our system and stored indefinitely, and original documents destroyed. Some AOs may also retain a copy of learner work and tutor feedback for their own records. If you require a paper copy of your work posted to your address, there will be an administration and postage charge of £10 each time a copy is sent.
  14. Postage costs for learner work submitted to NCC must be paid by the learner. In cases where sufficient postage has not been paid and affixed, NCC will recover a £10 administration fee from the learner to cover the cost of retrieving the work. We are unable to mark work where an administration fee is outstanding.
  15. Students who wish to place their course on hold in extenuating circumstances, will have their case reviewed by our management team, there is no guarantee that we'll approve the request. Students accept that if the qualification expires during a period that the course is on hold or following the course being resumed for the remaining tutor period, it will be their sole responsibility. Tutor support placed on hold, cannot surpass a period of three months.
  16. Certificates of completion and, if applicable, unit transcripts, will be provided in both digital and paper formats. Where the certificate needs to be shipped outside of the United Kingdom the following tracked shipping fees will apply: Europe: £15.00, Rest of World: £25.00. Payment will need to be made prior to the hard copy certificate being dispatched. NCC cannot accept liability for delays or non-delivery caused by customs stops or comandeerments. NCC will use provided contact details for shipment tracking.  

5. Warranties and limitation of liability

  1. We warrant that the Materials will be of satisfactory quality but do not warrant that the Materials will be error free.
  2. We warrant that we will perform any services provided hereunder with reasonable skill and care.
  3. Other than in respect of liability for death or personal injury arising from our negligence, we shall not be liable for: (a) losses that were not foreseeable to both parties when this Agreement was made; (b) losses that were not caused by any breach on our part; or (c) business losses and/or losses to non-consumers.
  4. Our liability for direct losses arising out of our negligence (other than in respect of liability for death or personal injury), breach of contract or any other cause of action arising out of or in connection with this Agreement shall be limited to the total price paid for the Distance Learning Package as quoted.
  5. Other than in respect of liability for death or personal injury arising from our negligence, we shall not be liable for any indirect or consequential loss or damage whatsoever (including without limitation any loss of profits, loss of revenue, loss of opportunity or your liabilities to third parties) which you may suffer arising out of or in connection with this Agreement.
  6. On completion of all assignments your work will be moderated internally. If amendments are required, your certification will not be applied for. Awarding bodies also reserve the right to moderate your work at any point.
  7. Awarding bodies may enforce changes to course specifications without prior warning. In such cases, NCC home Learning will not be liable for any additional work or additional fees required from the learner in order to meet the requirements of the changes.
  8. If a student fails to attend or notify NCC via [email protected] of their inability to participate in a scheduled observation (whether in-person, remote, or telephone/phone recorded) at least 72 working hours prior to the agreed date, they will be liable for the following costs to re-book at a later date £175 for an in-person observation, £95 for a remote observation, and £50 for a telephone/phone recorded observation, and must settle these charges before booking future observations.
  9. If a student has not prepared all the necessary evidence for their observation and consequently requires an additional observation session, they will be subject to the costs as detailed in point above (£175/£95/£50) of the guidelines. It is essential for students to be adequately prepared to avoid incurring additional charges.
  10. Awarding bodies may change during the course of a student’s studies. While we strive to map the qualification precisely to the original specification, ensuring continuity in the academic experience, there may be instances where adjustments to existing work are necessary or additional submissions are required.
  11. NCC Home Learning are not responsible for your future based on the outcome of your course, completion of a course provides no guarantees of work or progression.
  12. Learners where a placement is required – If learners leave their placement before course completion and external moderation, we are not liable for any inability to amend their work if required which may result in their certification not being issued.
  13. Learners where observations are required – It may take up to two months from the date of the observation request for the observation to be conducted, and learners cannot progress further until this is completed and approved. This duration will be deducted from the learner’s support period, which is typically 12 months in total. Observations will only take place between the hours of 9am and 5pm, Monday-Friday (excluding public holidays). If you work outside of these hours, you will be required to change your work hours to be observed, if this is not possible we would be unable to assist any further.

6. Other terms

  1. No relaxation or indulgence which we may extend to you shall affect our rights under these Terms and Conditions.
  2. If any part of these Terms and Conditions is held to be unenforceable by a Court of Law the remaining terms and conditions shall continue in force.
  3. All liabilities or obligations arising under these Terms and Conditions shall be enforceable against you after termination of this Agreement.
  4. You will notify us immediately, in writing, of any change in the address specified. Any notices required to be served under these Terms and Conditions will be deemed properly served if sent by way of prepaid post to your last known address.
  5. If your address is in Scotland then the laws of England & Wales will apply to these Terms and Conditions.
  6. Special Offers - NCC have the right to cancel any order that does not comply with special offer terms regardless of discount codes used at checkout.
  7. Our courses are written around legislation as it relates to England. There may be differences between English legislation and legislation in other parts of the world. Questions can be answered based on local laws where appropriate.  Your tutor would need to be notified of this when a particular question was answered..
  8. NCC works with many Reseller organisations and you may find their prices are dearer, or cheaper, than NCC’s and this will be due to promotions. Following purchase from one of NCC’s Reseller websites, if you find the same product cheaper on NCC, we will make arrangements with the Reseller to reimburse you with the difference between the NCC price and that charged by the Reseller. This arrangement will only be applied within 14 days of purchase as price promotions change periodically.
  9. NCC collaborates with various partners to expand our course offerings for learners. When you buy a course through NCC which is delivered by one of our partner companies, NCC handles the financial transactions, while the partner manages course delivery and support. We have longstanding relationships with all our partner companies and trust in their ability to deliver high-quality services to our learners.

7. Cancellation

  1. Under the Consumer Contracts Regulations 2014 you have a right to cancel this Agreement. Provided the Goods remain unopened and unused the Buyer has the right to cancel the Contract within 14 days of having received the Goods. If you want to cancel then you must complete the cancellation form here. Completion of the form will indicate whether your cancellation request is valid or invalid. Assuming your request to cancel is valid, any product supplied must be returned within 14 days of your cancellation request date, failure to return will result in the contract being upheld for the remaining payments terms and/or the existing payments made not being eligible for refund.
  2. The buyer has the right to cancel an order within 14 days of having received the goods as long as no services have been accessed.
  3. If your cancellation request is valid then you must return the Materials to the address as directed by NCC within 14 days. You must take good care of them until you do so. Upon receipt of returned materials and on condition they have not been damaged or marked in any way, then you will receive a full refund (unless a deposit has been paid, please see point 5 below). Course material returned in a un-resalable condition will be subject to an additional re-stocking fee of £45. With regard to course materials belonging to one of NCC’s partner Colleges, any charges will be at their discretion should the returned materials be damaged or marked in any way. Materials must be returned to NCC within 14 days of cancellation, after this time the cancellation request will become invalid and the full balance will become due.
  4. The buyer must pay for any costs associated with the return of goods.
  5. A £29 administration charge will be retained on all occasions to cover NCC’s costs in setting up a course. If you've paid in full, the balance minus the administration charge of £29 will be refunded provided it is within the 14 day cancellation period and the cancellation request is valid. The £29 administration charge will be retained and held for a period of 6 months should you wish to return to study with NCC.
  6. Any postage and packing charges incurred by delivery of course materials to the buyer are non-refundable.
  7. If you pay via instalments you can cancel your order within 14 days of placing the order.  Any deposit paid is non-refundable. This deposit can be transferred to a different course at NCC's sole discretion.
  8. If we have to collect the Materials from you then we may charge you reasonable costs for doing so. Should the materials be damaged in any way and not suitable for resale, a minimum charge of £45 will be charged over and above the reasonable costs of collecting the materials.
  9. Unless the parties have agreed otherwise, you will not have the right to cancel by giving notice of cancellation for the supply of computer software if they are unsealed by you or for the supply of online courseware which has been accessed by you. This also applies to the purchase of books. No refund or cancellation can be applied for any material which is book only and purchased as a separate sale.
  10. If you wish to transfer to a different course, we may at our sole discretion agree to such transfer and a fee of £45 will be incurred. If we agree that you may transfer to a different course, we will transfer the fees paid for the Distance Learning Package you wish to discontinue towards the amount payable for the new course PROVIDED THAT we receive payment from you for the balance of fees due in respect of the new course (if more expensive than the discontinued Distance Learning Package). Should the new course be less expensive, there will be no refund of any fees due.
  11. From the point of purchase/login details being provided, customers have fourteen days to consider their purchase (the ‘Cooling Off Period’), after the Cooling Off Period has elapsed, the option to cancel will not be allowed.
  12. The option to cancel will not be allowed under any circumstance (either within or outside of the cooling off period) if the course has been accessed and work submitted for marking.

8. Data protection and General Data Protection Regulation (GDPR)

You agree that, in relation to information, which we hold on you from time to time, we may:

  1. Use your information to provide the Materials to you and otherwise perform our obligations and enforce our rights under these Terms and Conditions.
  2. Use your information to inform you about our other courses, products or services which may be of interest to you.
  3. Share your information with our group and associated companies, to enable them to inform you about other products or services which may be of interest to you.
  4. You have a legal right to stop us from contacting you, or giving your details to others for direct marketing purposes, you can do this by contacting us by mail, email or phone.

9. Complaints

From time to time you may feel the need to make a complaint. In the first instance contact student support to register your complaint, this will then be communicated internally and we will make an initial response within 24 hours during Monday-Friday.

  1. Your complaint will be assessed for validity and a decision over any action required will be considered.
  2. You will be informed of any appropriate outcome or actions within 5 working days.
  3. You will be recompensed if appropriate with fees returned if the complaint is justified.
  4. NCC's decision is final, you may escalate to senior management at any point of the process.

Use of the NCC website

Your use of the Web pages located within www.ncchomelearning.co.uk ("Website") is subject to the terms set out below ("Terms"). These Terms apply only to this Website and not to any other website. Your use of any pages on the Website will constitute your agreement to comply with these Terms. We may amend the Terms at any time by posting the amended terms on this site.

Terms of use

You may not reproduce, duplicate, copy, download, sell, resell, or otherwise exploited for any commercial purpose the Website without the express written consent of NCC Home Learning. Any unauthorized use terminates the license granted by NCC Home Learning.
